The United States Attorney's Office announced that during a federal court session in Missoula, on September 22, 2011, before U.S. District Judge Donald W. Molloy, GIOVANNI DELAWARE BLOOD, a resident of Missoula, was sentenced to a term of:

Prison: 30 months

Special Assessment: $100

Supervised Release: 10 years

BLOOD was sentenced in connection with his guilty plea to possession of child pornography.

In an Offer of Proof filed by Assistant U.S. Attorney Cyndee L. Peterson, the government stated it would have proved at trial the following:

During an undercover peer-to-peer operation, U.S. Department of Homeland Security agents determined an IP address in Missoula had files containing child pornography available for download. Agents determined BLOOD was the subscriber on the IP address. Agents obtained a search warrant for BLOOD's residence, and served the warrant on March 11, 2009.

At the time of the search, BLOOD was interviewed. BLOOD gave the agents a laptop, admitted he received child pornography on the laptop, and told agents specific search terms he utilized to locate the child pornography files via LimeWire.

A forensic examiner located images of child pornography on the laptop. Another laptop and two external hard drives were also analyzed, and images of child pornography were located. The forensic examiner determined images were received between December 27, 2007, and October 20, 2008.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that BLOOD will likely serve all of the time imposed by the court. In the federal system, BLOOD does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

The investigation was conducted by the U.S. Department of Homeland Security.
