The United States Attorney's Office announced that during a federal court session in Helena, on November 15, 2011, before Senior U.S. District Judge Charles C. Lovell, GLENN STEVEN SCOTT, a 54-year-old resident of Boulder, appeared for sentencing. SCOTT was sentenced to a term of:

Prison: 135 months

Special Assessment: $200

Forfeiture: computer equipment

Supervised Release: 18 years

SCOTT was sentenced in connection with his guilty plea to possession of child pornography and Destruction or Removal of Property to Prevent Seizure.

The government stated it would have proved at trial the following:

On May 12, 2009, an individual identified here are "John Doe" reported to the Jefferson County Sheriff's Office that his former employer, SCOTT, had child pornography on a computer at his residence in Boulder. "John Doe" reported that SCOTT, an engineer who regularly traveled out of the country on business, allowed "John Doe" to retrieve and set up a computer from a storage shed for "John Doe's" daughter to use while SCOTT was away on business. As "John Doe" did so, he observed child pornography images on the computer. After SCOTT came home, he and "John Doe" had a falling out about work and "John Doe" reported the incident.

John Doe" stated that the pictures on the computer were of young prepubescent females that were posing nude and wearing make-up and that the images were disturbing and offensive in nature to him and he deemed the images pornographic. The age range of the girls, according to "John Doe", was between the ages of 5 to 9-years-old. "John Doe" advised that when he viewed the images, the computer was located inside the travel trailer, however, "John Doe" stated that since SCOTT's return from China, he had probably moved the computer from the trailer to the partially built home that SCOTT was then constructing. "John Doe" advised law enforcement that SCOTT also had a laptop that SCOTT usually kept with him and that he usually traveled with it.

On May 21, 2009, numerous computers and computer related media were seized during a search of SCOTT's residence. When interviewed, SCOTT claimed there would be no child pornography found, and that "John Doe" was attempting to blackmail him given their employment difficulties.

A forensic examination of SCOTT's computer equipment revealed numerous child pornography images on SCOTT's laptop computer, a separate removable hard drive, 2 thumbdrives and numerous CDs and other media. The oldest date of copied images found on a CD was May 2003. The computer that "John Doe" originally reported contained child pornography was found, but the hard drive and CD drive appeared to be missing.

Later in June 2009, "John Smith", another of SCOTT's employees came in to the Jefferson County Sheriff's Office to report that he had in his possession the smashed computer equipment removed from SCOTT's other computer. "John Smith" reported that SCOTT told him "John Doe" had turned him in for child pornography and prior to the search warrant being served, SCOTT took the hard drive from the computer and smashed it, then told "John Smith" to get rid of it. "John Smith" told SCOTT he would, but hid the smashed equipment and then turned it in to the Jefferson County Sheriff's Office.

While awaiting trial, SCOTT was released with special conditions, which included electronic monitoring. On June 10, 2010, probation received an alert that SCOTT's electronic monitor appeared to have been removed. Attempts to locate him were made and finally an arrest warrant was issued.

On November 1, 2010, in Mississippi, SCOTT was arrested living in a campground under the stolen identity of "James McDonald."

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that SCOTT will likely serve all of the time imposed by the court. In the federal system, SCOTT does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
