Leslie Mark Galles Sentenced in U.S. District Court
The United States Attorney's Office announced that during a federal court session in Billings, on May 10, 2012, before Chief U.S. District Judge Richard F. Cebull, LESLIE MARK GALLES, a 59-year-old resident of Rapid City, South Dakota, appeared for sentencing. GALLES was sentenced to a term of:
- Prison: 38 months
- Special Assessment: $200
- Supervised Release: 3 years
GALLES was sentenced in connection with his guilty plea to being a felon-in-possession of a firearm and ammunition.
In an Offer of Proof filed by Assistant U.S. Attorney Paulette L. Stewart, the government stated it would have proved at trial the following:
On November 20, 2008, GALLES was convicted of second degree burglary in South Dakota which therefore prohibited him possessing firearms or ammunition.
During a traffic stop near Columbus on February 7, 2011, GALLES admitted to the officer that he possessed a firearm under the driver's seat of his vehicle. The firearm was a Heritage Rough Rider .22 caliber revolver. GALLES also had his pants' pockets full of ammunition - approximately 300 rounds of various ammunition.
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that GALLES will likely serve all of the time imposed by the court. In the federal system, GALLES does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
The investigation was a cooperative effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Stillwater County Sheriff's Office, and the South Dakota Probation and Parole.
