Timothy Jospeh Henneberry Sentenced in U.S. District Court
The United States Attorney's Office announced that during a federal court session in
Billings, on June 28, 2012, before Chief U.S. District Judge Richard F. Cebull, TIMOTHY JOSPEH HENNEBERRY, a 20-year-old resident of Billings, appeared for sentencing. HENNEBERRY was sentenced to a term of:
Prison: 51 months
Special Assessment: $400
Supervised Release: 3 years
HENNEBERRY was sentenced in connection with his guilty plea to (3) counts of distribution of Ecstasy and possession of a stolen firearm.
In an Offer of Proof filed by Assistant U.S. Attorney Marcia K. Hurd, the government stated it would have proved at trial the following:
On March 10, 2011, HENNEBERRY sold 11 Ecstasy pills, a Schedule I controlled substance, to an undercover agent in Billings.
On March 28, 2011, HENNEBERRY sold 10 Ecstasy pills, a Schedule I controlled substance, to the undercover agent in Billings.
On April 29, 2011, HENNEBERRY sold the undercover agent a Russian, Mosin Nagant, model 1891/30, 7.62 caliber rifle in Billings. The rifle was reported stolen and HENNEBERRY had reasonable cause to believe the firearm was stolen. In fact, HENNEBERRY told the undercover agent that the rifle was "hot."
On May 10, 2011, HENNEBERRY brokered a deal to help sell to the undercover agent 100 Ecstasy pills, a Schedule I controlled substance. HENNEBERRY made arrangements with his source to sell the pills, called to arrange the deal, was present during the deal, and introduced the agent to the two sources who sold the agent the pills in HENNEBERRY's presence. HENNEBERRY received $50 for arranging the deal.
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that HENNEBERRY will likely serve all of the time imposed by the court. In the federal system, HENNEBERRY does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
