David Wayne Sconce Sentenced in U.S. District Court
The United States Attorney's Office announced that during a federal court session in Missoula, on October 26, 2012, before U.S. District Judge Dana L. Christensen, DAVID WAYNE SCONCE, a 56-year-old resident of Huson, appeared for sentencing. SCONCE was sentenced to a term of:
Probation: 5 years with 3 months electronic monitoring
Special Assessment: $100
Restitution: $280 to pawn shops
SCONCE was sentenced in connection with his guilty plea to possession of a stolen firearm.
In an Offer of Proof filed by Assistant U.S. Attorney Paulette L. Stewart, the government stated it would have proved at trial the following:
On August 17, 2010, SCONCE pawned a Remington 22-250 rifle near Missoula. SCONCE provided his Montana identification during the transaction. The employee noted SCONCE's identification number, date of birth, and address.
The rifle was owned by SCONCE's neighbor who had loaned the rifle to SCONCE but never received it back from him.
When questioned, SCONCE admitted to possessing and pawning his neighbor's rifle without his neighbor's permission. SCONCE made a statement to the effect that he could not give it back because he sold it.
The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
