Jesse J. Moore Sentenced in U.S. District Court
The United States Attorney's Office announced that during a federal court session in Billings, on November 28, 2012, before Senior U.S. District Judge Jack D. Shanstrom, JESSE J. MOORE, a 28-year-old resident of Billings, appeared for sentencing. MOORE was sentenced to a term of:
Prison: 12 months and 1 day
Special Assessment: $100
Supervised Release: 3 years
MOORE was sentenced in connection with his guilty plea to possession of stolen firearms.
In an Offer of Proof filed by Assistant U.S. Attorney Marcia K. Hurd, the government stated it would have proved at trial the following:
In February 2012, the Yellowstone County Sheriff's Office received a report that MOORE, a CNA hired to care for an elderly man in his home in Shepherd, had stolen items from that residence. Among the items missing were a Arminius, model HW5, .32 caliber revolver, a Henry Repeating Company, model H001., .22 caliber lever-action rifle, and a High Standard, model K-120/18-7 Riot, 12 gauge, pump-action shotgun, SN 3049992.
When questioned, MOORE admitted that he had stolen numerous items from the residence, including the three guns. He had pawned some of the items, given others as gifts, but still had the guns in his possession.
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that MOORE will likely serve all of the time imposed by the court. In the federal system, MOORE does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
The investigation was a cooperative effort between the Yellowstone County Sheriff's Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
