RALEIGH MAN CHARGED IN CHILD PORNOGRAPHY CASE
GREENVILLE - United States Attorney George E.B. Holding that on Wednesday, November 12, 2008, a Federal Grand Jury returned an eight-count Criminal Indictment on BILLY BURGESS, 63, of Raleigh, North Carolina. BURGESS has been charged with three counts of receipt of child pornography, in violation of Title 18, United States Code, Section 2252(a)(2); four counts of transportation of child pornography, in violation of Title 18, United States Code, Section 2252(a)(1), and one count of possession of child pornography, in violation of Title 18, United States Code, Section 2252(a)(4)(B).
From March 7, 2005, to March 17, 2005, images of minors engaged in sexually explicit conduct were transported by use of a computer and an interactive computer service. BURGESS, who has prior federal child pornography convictions and is a registered sex offender, received these images via the Internet and were found in possession of them.
“This case is particularly troubling in that it reveals a recidivist nature of these crimes. We look forward to presenting this case to the Court and we will seek justice for these crimes,” commented Mr. Holding.
An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed innocent until and unless proven guilty in court.
This case is part of the Project Safe Childhood initiative, a national program aimed at ensuring that criminals exploiting children are effectively prosecuted by making full use of all available law enforcement resources at every level. Investigation of the case was conducted by the Federal Bureau of Investigation, the United States Postal Inspection Service, the North Carolina State Bureau of Investigation and the Raleigh Police Department. Assistant United States Attorney Ethan Ontjes served as prosecutor for the government.
