FAYETTEVILLE CHILD RAPIST RECEIVES 40-YEAR
PRISON SENTENCE FOR CHILD PORNOGRAPHY
WILMINGTON - United States Attorney George E.B. Holding announced that in federal court yesterday Senior United States District Judge James C. Fox sentenced DANIEL NICHOLAS BUCZKOWSKI, 54, of Fayetteville, North Carolina, to 480 months’ imprisonment. The Court accepted testimony from the victim at sentencing in which the victim described BUCZKOWSKI’s almost daily rape of her from age 7 to age 10. The victim also testified that BUCZKOWSKI had shown her child pornography during this time period. Therefore, the Court found a sentencing enhancement applicable based on distribution of child pornography to a minor that was intended to persuade, induce, entice or coerce the minor to engage in illegal activity and also a sentencing enhancement was applicable based on BUCZKOWSKI’s pattern of activity involving the sexual abuse of a minor.
A Federal Grand Jury returned a Criminal Indictment on May 28, 2008. On January 28, 2009, BUCZKOWSKI was found guilty by a jury of 27 counts of transportation of child pornography, in violation of Title 18, United States Code, Section 2252(a)(1) and one count of possession of child pornography, in violation of Title 18, United States Code, Section 2252(a)(4)(B).
BUCZKOWSKI’S child pornography collection was discovered in May of 2007, after he took his laptop computer into a local computer shop for repair. During the course of the repairs, the shop’s owner discovered pictures of child pornography on BUCZKOWSKI’S computer, including pictures showing the severe sexual abuse of prepubescent children, and called the Fayetteville Police Department. In examining BUCZKOWSKI’S child pornography collection, investigators furthermore discovered that BUCZKOWSKI had used the images of child pornography to create collages in which BUCZKOWSKI’S homemade photographs of himself engaged in sex acts were surrounded by multiple images of child pornography. BUCZKOWSKI transported images of child pornography to and from a work assignment for a contractor in Iraq. Independently of the discovery of child pornography on BUCZKOWSKI’S computer, investigators also developed evidence that BUCZKOWSKI was actively engaged in the sexual abuse of a child.
BUCZKOWSKI has pled guilty to three state charges which included first degree rape, first degree sexual offense, and taking indecent liberties with children. Sentencing for these charges has not yet been scheduled.
“We are very pleased with the sentence. This case represents yet another illustration of the very direct connection between child pornography crimes and the hands-on sexual abuse of children. Through the dedicated work of the Cumberland County Sheriff’s Department, the Fayetteville Police Department, and the FBI, and their seamless cooperation this case has been brought to a successful conclusion,” commented Mr. Holding.
Investigation of the case was conducted by the Cumberland County Sheriff’s Department and the Fayetteville Police Department. Assistant United States Attorneys David Bragdon and Jay Exum served as prosecutorS for the government.
