Offense Draws 27 Month Sentence, 15 Years Supervised Release

Greensboro, N.C. – An individual who pleaded guilty to failure to register as a sex offender was sentenced on May 17, 2011, announced United States Attorney Ripley Rand. David Alan Heming, 48, formerly of Alamance County, North Carolina, was sentenced by United States District Judge William L. Osteen, Jr., to 27 months in prison to be followed by 15 years of supervised release.

Heming was convicted in 2004 of indecent liberties with a child in Alamance County. He moved to Pennsylvania without updating his sex offender registration, was extradited and convicted in Alamance County Superior Court of failure to register in July 2009, receiving a 90-day sentence. Shortly after his release he again moved to Pennsylvania without registering as a sex offender. His interstate travel and failure to register as a sex offender made him subject to federal law regarding sex offender registration.

This case was investigated by the United States Marshals Service and prosecuted by Assistant United States Attorney Anand P. Ramaswamy.

“The U.S. Marshals Service has joined with state and local law enforcement offices of this region and the United States Attorney’s Office in the Middle District of North Carolina to protect the community from the dangers of noncompliant sex offenders,” said U.S. Marshal Bill Stafford. “As a law enforcement team, we are committed to vigorously pursuing these violators and bringing them to justice regardless of where they may be hiding.”

Heming is the first defendant prosecuted in this district under the Sex Offender Registration and Notification Act (SORNA), also known as the Adam Walsh Child Protection and Safety Act, which was enacted in 2006.
