Deported Alien Who Illegally Returned to United States and Sexually Assaulted Minor Sentenced to Additional 57 Months in Federal Prison

Las Vegas, Nev. – Sergio Hugo Hernandez, 31, of Las Vegas, was sentenced on July 11, 2008, to more than four and a half years in federal prison which must be served in addition to the sentence recently imposed on Hernandez by the State of Nevada for battery with intent to commit sexual assault and lewdness with a minor under the age of fourteen, announced Gregory A. Brower, United States Attorney for the District of Nevada. Hernandez pleaded guilty in February to being a deported alien found unlawfully in the United States.

On April 6, 2007, Hernandez, an alien, who had been deported and removed on July 29, 2003, from the United States, was found in the United States, having reentered and remained in this country without permission. At the time Hernandez was removed from the United States on July 29, 2003, he had been convicted of car-jacking with use of a deadly weapon in the State of California for which he was sentenced to seven years in prison.

Hernandez' unlawful presence in the United States on April 6, 2007, came to light during the investigation of a minor's sexual assault. Hernandez sustained two state felony convictions in 2007 in connection with the minor's assault and, on January 9, 2008, he was sentenced to state prison for a term of ten years to life.

The case was investigated by the United States Immigration and Customs Enforcement and Henderson Police Department, and prosecuted by Assistant United States Attorney Kimberly M. Frayn.
