An indictment was returned charging Charles A. DePalmo, Jr., age 44, whose last known address was Massillon, Ohio, with escape, said Steven M. Dettelbach, United States Attorney for the Northern District of Ohio.

On May 19, 2012, while serving a federal sentence for felon in possession of a firearm and false statements, DePalmo escaped from home detention. He was apprehended on May 25, 2012, in Stark County.

The investigation preceding the indictment was conducted by the U.S. Marshal Service. The matter was presented for indictment by Assistant United States Attorney Linda H. Barr.

If convicted, the defendant’s sentence will be determined by the court after review of factors unique to this case, including the prior criminal record, and the defendants role in the offense and the characteristics of the violation. In all cases, the sentence will not exceed the statutory maximum and in most cases it willbe less than the maximum.

An indictment is only a charge and is not evidence of guilt. A defendant is entitled to a
fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
