Jury Finds Indiana, Pa., Man Guilty Of Cocaine Trafficking Charge
PITTSBURGH, Pa. - Acting United States Attorney Robert S. Cessar announced today, April 8, 2010, that after deliberating four hours, a jury of five men and seven women found Derrick Steven Clemons guilty of one count of violating federal narcotics laws.
Clemons, age 32, was tried before United States District Judge Arthur B. Schwab in Pittsburgh, Pennsylvania.
According to Assistant United States Attorney Charles A. Eberle, who prosecuted the case, the evidence presented at trial established that Clemons possessed with intent to distribute 5 grams or more of crack on October 13, 2007, in Indiana Borough, Indiana, Pennsylvania.
Judge Schwab scheduled sentencing for September 24, 2010, at 9:30 a.m. The law provides for a total sentence of 40 years in prison, a fine of $2,000,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed is based on the seriousness of the offense and the criminal history, if any, of the defendant.
The Pennsylvania State Police, the Indiana Borough Police Department, the Federal Bureau of Investigation's Safe Streets Task Force, and the Indiana County District Attorney's Drug Task Force conducted the investigation that led to the prosecution of Clemons.
