Pittsburgh Man Pleads Guilty To Drug, Gun Law Offenses
PITTSBURGH, Pa. - Acting United States Attorney Robert S. Cessar announced today, April 26, 2010, that on April 23, 2010, Kevin Lamont Johnson a/k/a Brian Miller, a resident of Pittsburgh, Pennsylvania, pleaded guilty in federal court to charges of violating federal firearms and narcotics laws.
Johnson, age 25, pleaded guilty to three counts before United States District Judge Arthur J. Schwab.
In connection with the guilty plea, Assistant United States Attorney Almon S. Burke, Jr. advised the court that after having been convicted on January 16, 2008, of the crime of possession with intent to deliver heroin, and after having been convicted on March 3, 2005, of the crime of carrying a firearm without a license, which are crimes punishable by imprisonment for a term exceeding one year, on June 20, 2008, during a traffic stop, Johnson was in possession of a loaded 9mm pistol in connection with 5.86 grams of crack, which he possessed with the intent to deliver. Federal law prohibits anyone who has been convicted of a crime punishable by a term of imprisonment exceeding one year to possess a firearm or ammunition.
Judge Schwab scheduled sentencing for October 15, 2010, at 9:30 a.m. The law provides for a total sentence of life in prison, a fine of $2,500,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed is based upon the seriousness of the offenses and the criminal history, if any, of the defendant.
This case is being prosecuted under Project Safe Neighborhoods, a collaborative effort by federal, state and local law enforcement agencies, prosecutors and communities to prevent, deter and prosecute gun crime.
The Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the City of Pittsburgh Police Department conducted the investigation that led to the prosecution of Johnson.
