Brockport Man Sentenced To 5 Years Probation For Gun Law Violations
JOHNSTOWN, Pa. - Acting United States Attorney Robert S. Cessar announced today, June 3, 2010, that James A. Volpe, a resident of Brockport, Pennsylvania, has been sentenced in federal court in Johnstown to five years probation, the first 12 months of which must be satisfied by condition of home confinement with electronic monitoring, and 100 hours of community service on his conviction of violating various federal laws.
United States District Judge Kim R. Gibson imposed the sentence on Volpe, age 51.
According to information presented to the court by Assistant United States Attorney John J. Valkovci, Jr., on May 17, 2007, Volpe distributed anabolic steroids, and on the same date he mailed anabolic steroids that were misbranded as drugs that require a prescription from a practitioner licensed by law to administer.
In addition, on September 12, 2007, Volpe, who had been convicted in 1981 in Orange County, New York, of possession of stolen property, unlawfully possessed a pistol and two rifles. Federal law prohibits persons who have been convicted of a crime punishable by imprisonment for more than one year from possessing ammunition or firearms. Possession of stolen property is such a crime.
According to Mr. Cessar, Volpe is being prosecuted as part of Project Safe Neighborhoods, a collaborative effort by federal, state, and local law enforcement agencies, prosecutors, and communities to prevent, deter, and prosecute gun crime.
Mr. Cessar commended the Food and Drug Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives for the investigation leading to the successful prosecution of Volpe.
