PITTSBURGH, Pa. ‑ A resident of Burgettstown, Pa., has been sentenced in federal court to 24 months in prison and three years supervised release on his conviction of federal firearms offenses, United States Attorney David J. Hickton announced today.

United States District Judge Terrence F. McVerry imposed the sentence on Albert Leroy Ervin, 48.

According to information presented to the court, the defendant possessed a .22 Long Rifle caliber revolver belonging to his deceased uncle and ammunition, despite two previous felony convictions, an active Protection From Abuse order and a pending Aggravated Assault case. The defendant was acquitted by a jury of using the gun to rob the Langloth Post Office on Oct. 9, 2008.

Prior to imposing sentence, Judge McVerry considered the defendant's 17 convictions in determining an appropriate sentence and ordered that Ervin begin to serve the remainder of his sentence after he gets off of house arrest on June 25, 2011. Ervin's house arrest sentence was imposed by a Washington County court for Driving Under Suspension.

Assistant United States Attorney Ross E. Lenhardt prosecuted this case on behalf of the government.

U.S. Attorney Hickton commended the U.S. Postal Inspection Service for the investigation leading to the successful prosecution of Ervin.
