Fairview Man Charged with Federal Income Tax Law Violations

ERIE, Pa. - A resident of Fairview, Pennsylvania, has been indicted by a federal grand jury in Erie on charges of violating federal income tax laws, United States Attorney David J. Hickton announced today.

The thirteen-count indictment named Kevin Hanlon, 46, as the sole defendant.

According to the indictment presented to the court, Hanlon failed to make payroll tax payments to the Internal Revenue Service on behalf of his employees at KH Express, LLC and CJT Logistics, Incorporated from 2005 through 2008. According to the Indictment, although payroll taxes (including income, medicare and social security taxes) had been withheld from employee pay, Hanlon failed to pay over to the IRS approximately $473,647.32 of the employee payroll taxes that had been withheld.

The law provides for a maximum total sentence of 65 years in prison, a fine of $130,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

Assistant United States Attorney Marshall J. Piccinini is prosecuting this case on behalf of the government.

The Internal Revenue Service, Criminal Investigation conducted the investigation leading to the indictment in this case.

An indictment is an accusation. A defendant is presumed innocent unless and until proven guilty.
