
Rosebud Man Pleads Guilty to Sexual Abuse

United States Attorney Brendan V. Johnson announced that Floyd Black Spotted Horse, age 43, of Rosebud, South Dakota, appeared before United States District Judge Roberto A. Lange on January 25, 2011, and pled guilty to an Indictment that charged him with Sexual Abuse. The maximum penalty upon conviction is up to life imprisonment, a $250,000 fine, or both, up to life of supervised release, and a $100 special assessment. Restitution may also be ordered.
The charge relates to Black Spotted Horse knowingly engaging in and attempting to engage in a sexual act with a female, who at the time was incapable of apprising the nature of the conduct and was physically incapable of declining participation in the sexual act, on January 30, 2010, in Todd County. The investigation was conducted by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Tim Maher.
A presentence investigation was ordered and a sentencing date was set for April 11, 2011. The defendant was remanded to the custody of the US Marshal pending sentencing.
