
Mission Man Pleads Guilty to Assault Resulting in Serious Bodily Injury

United States Attorney Brendan V. Johnson announced that Benjamin Wayne Kitteaux, age 23, of Mission, South Dakota, appeared before United States District Judge Roberto A. Lange on March 8, 2011, and pled guilty to count 2 of the indictment that charged him with Assault Resulting in Serious Bodily Injury and Aiding and Abetting. The maximum penalty upon conviction is 10 years of imprisonment, a $250,000 fine, or both; up to three years of supervised release; and a $100 special assessment. Restitution may also be ordered. The charge relates to Kitteaux and two other men randomly attacking another man in Todd County on July 13, 2010. Said assault resulted in serious bodily injury to the victim. The investigation was conducted by Rosebud Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Meghan N. Dilges. A presentence investigation was ordered, and a sentencing date was set for May 23, 2011. The defendant must self-report to the U.S. Marshal on March 31, 2011, to be held pending sentencing. |
