Mexican Citizen Indicted for Illegal Re-Entry After Deportation

United States Attorney Brendan V. Johnson announced that a Mexican citizen has been indicted by a federal grand jury for illegal re-entry after deportation.

Francisco Javier Landin-Martinez, a/k/a Francisco Javier Landi-Martinez, age 24, was indicted by a federal grand jury on May 10, 2011, for illegal reentry after deportation. He appeared before United States Magistrate Judge Mark A. Moreno on May 12, 2011, and pled not guilty to the indictment.

The maximum penalty upon conviction is two years in custody, a $250,000 fine, or both; one year of supervised release; and a $100 Special Assessment. Restitution may also be ordered. The charge is merely an accusation, and Landin-Martinez is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Department of Homeland Security, Immigration and Customs Enforcement. Assistant United States Attorney Jay Miller is prosecuting the case. Landin-Martinez was remanded to the custody of the United States Marshal. A trial date has not yet been set.
