Mexican Citizen Pleads Guilty to Illegal Reentry After Deportation

United States Attorney Brendan V. Johnson announced that Francisco Javier Landin-Martinez, a/k/a Francisco Javier Landi-Martinez, age 24, a Mexican citizen, appeared before United States District Judge Roberto A. Lange on June 21, 2011, and pled guilty to an indictment that charged him with Illegal Reentry After Deportation. The maximum penalty upon conviction is two years in custody, a $250,000 fine, or both; one year of supervised release; and a $100 special assessment.

On May 4, 2011, Landin-Martinez was a passenger in a Ford F350 pickup truck with commercial license plates being driven by his employer. The vehicle stopped at a temporary vehicle inspection checkpoint operated by the South Dakota Highway Patrol/Motor Carrier Services near Gettysburg, South Dakota. Troopers asked Landin-Martinez for identification, and he produced a card issued by the Government of Mexico bearing his name.

During the investigation, it was learned that Landin-Martinez had previously been arrested by Immigration and Customs agents on December 18, 2007, in Sioux Falls, South Dakota. He was ordered removed to Mexico on or about January 8, 2008, and removed to Mexico through Laredo, Texas, on or about January 16, 2008. Landin-Martinez had not made a request to the Secretary of the Department of Homeland Security or Attorney General for permission to re-enter the United States.

The investigation was conducted by the Department of Homeland Security, Immigration and Customs Enforcement. The case is being prosecuted by Assistant United States Attorney Jay Miller.

A presentence investigation was ordered, and a sentencing date was set for August 3, 2011. The defendant was remanded to the custody of the United States Marshal pending sentencing.
