United States Attorney Brendan V. Johnson announced that two men charged with Bank Burglary were sentenced on August 4, 2011, by U.S. District Judge Roberto A. Lange. Kalup McGhee, age 19, of Pukwana, was sentenced to 26 months of imprisonment, three years of supervised release, a $100 victim assessment, and $33,075.70 restitution; Kelly McGhee, Jr., age 21, of Ft. Thompson, was sentenced to 27 months of imprisonment, three years supervised release, a $100 victim assessment, and $38,404.11 restitution.
The defendants were indicted by a federal grand jury on January 11, 2011. In December 2009, they broke into a convenience store in Wessington Springs and stole an Automated Teller Machine owned by a federally insured bank. Kalup McGhee pled guilty on April 18, 2011, and Kelly McGhee pled guilty on May 2, 2011.
This case was investigated by the South Dakota Division of Criminal Investigation, the Jerauld County Sheriff's Department, the Bureau of Indian Affairs, Crow Creek and Lower Brule Agencies, and the Federal Bureau of Investigation. Assistant U.S. Attorney Eric Kelderman prosecuted the case.
Both defendants were immediately turned over to the custody of the U.S. Marshal.
