United States Attorney Brendan V. Johnson announced that a Guatemalan man charged with Illegal Reentry After Deportation was sentenced on August 4, 2011, by United States District Judge Roberto A. Lange. Gilmar Estuardo Santiago-Lopez, age 21, was sentenced to 92 days in custody and a $100 special assessment to the Victim Assistance Fund. He will be turned over to ICE for deportation proceedings on August 18, 2011.
On May 18, 2011, Santiago-Lopez was encountered at the Jerauld County Sheriff's Office in Wessington Springs, South Dakota, by Immigration and Customs Enforcement during an investigation of vehicle registration fraud. During the investigation, it was learned that Santiago-Lopez was previously ordered removed by an immigration judge on January 8, 2009. He was removed to Guatemala on June 4, 2009, through Alexandria, Louisiana. He re-entered the United States in July 2009. Santiago-Lopez had not made a request to the Secretary of the Department of Homeland Security or Attorney General for permission to re-enter the United States.
This case was investigated by the Department of Homeland Security, Immigration and Customs Enforcement. Assistant United States Attorney Jay Miller prosecuted the case.
Santiago-Lopez was immediately turned over to the custody of the United States Marshal to begin serving his sentence.
