United States Attorney Brendan V. Johnson announced that an Oelrichs, South Dakota, man charged with Felon in Possession of a Firearm was sentenced on August 15, 2011, by United States District Judge Roberto A. Lange. Earl D. Dowty, age 45, was sentenced to 120 months in custody, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund.
Dowty was indicted by a federal grand jury on March 15, 2011. On November 24, 2010, Dowty, a convicted felon, possessed a firearm while in Rosebud, South Dakota. Dowty pawned the firearm for $50 at Pro Pawn in Mission, South Dakota, and signed his name to the pawn ticket. The firearm had been shipped and transported in interstate commerce, produced, and manufactured outside the state of South Dakota. Dowty pled guilty to the charge on May 18, 2011.
This case was investigated by the Federal Bureau of Investigation. Assistant United States Attorney Marie H. Ruettgers prosecuted the case.
Dowty was immediately turned over to the custody of the United States Marshal.
