United States Attorney Brendan V. Johnson announced that a Rapid City man charged with conspiracy to distribute and possession with intent to distribute marijuana was sentenced on September 19, 2011, by United States District Judge Jeffrey Viken. Jaret Alan Hagar, a/k/a Jarret Alan Hagar, age 26, was sentenced to 46 months in custody, 6 years of supervised release, and a $100 special assessment to the Victim Assistance Fund.
Hagar was indicted for conspiracy to distribute a controlled substance by a federal grand jury on January 19, 2011. The charges stem from an incident in July 2008 when two individuals were pulled over by the South Dakota Highway Patrol with 30 lbs. of marijuana in their vehicle. Law enforcement determined that Hagar was one of the suppliers of that marijuana, which he or someone else brought from Denver, Colorado. Hagar distributed marijuana in the Rapid City/Black Hills area, or had it transported to Sioux Falls for distribution. Hagar has a 2005 conviction in Pennington County for Possession of Between One-Half Pound and One Pound of Marijuana.
Hagar pled guilty to a superseding information that charged him with conspiracy to distribute and possession with intent to distribute marijuana on June 16, 2011. He also pled guilty to an indictment alleging that he had a prior felony drug conviction.
This case was investigated by the DEA. Assistant United States Attorney Jay Miller prosecuted the case.
