Eagle Butte Man Sentenced for Assault

United States Attorney Brendan V. Johnson announced that an Eagle Butte man charged with Striking, Beating and Wounding was sentenced on September 19, 2011, by United States District Judge Roberto A. Lange. Cody Yellow, age 23, was sentenced to 6 months in custody and a $10 special assessment to the Victim Assistance Fund.

Yellow was indicted for Assault with a Dangerous Weapon by a federal grand jury on April 12, 2011. The charge stems from a March 19, 2011, assault by Yellow on a female near his residence in Eagle Butte, South Dakota. Yellow unlawfully assaulted the victim by striking, beating, and wounding her. He pled guilty to a Superseding Information charging him with Assault by Striking, Beating and Wounding on August 3, 2011.

This case was investigated by the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant United States Attorney Mikal Hanson prosecuted the case.

Yellow was immediately turned over to the custody of the United States Marshal to finish serving his sentence.
