United States Attorney Brendan V. Johnson announced that Chad J. Whirlwind Soldier, a/k/a Chad Colombe, a/k/a Chad Boyd, a/k/a Winks, age 31, of Mission, appeared before United States District Judge Roberto A. Lange on September 20, 2011, and pled guilty to a superseding indictment that charged him with Assaulting, Resisting, and Impeding a Federal Officer. The maximum penalty upon conviction is 8 years in custody, a $250,000 fine, or both.
The charge stems from a January 2011 traffic stop near the intersection of U.S. Highway 83 and S.D. Highway 44. Whirlwind Soldier was driving a vehicle that failed to stop. Law enforcement conducted a DUI investigation, revealing $2,500 in United States currency in the Defendant’s pants pocket. They arrested Whirlwind Soldier for driving under the influence. When an officer asked Whirlwind Soldier to step out of his vehicle, the Defendant faced off with the officer and struck him in the chest with his upper body and shoulder.
Rosebud Law Enforcement Services and the Northern Plains Safe Trails Drug Enforcement Task Force conducted the investigation. Assistant United States Attorney Jay Miller is prosecuting the case.
A presentence investigation was ordered, and a sentencing date was set for December 12, 2011. The defendant was remanded to the custody of the United States Marshal pending sentencing.
