Little Eagle Man Indicted for Habitual Domestic Abuse

United States Attorney Brendan V. Johnson announced that a Little Eagle, South Dakota, man has been indicted by a federal grand jury for allegations that he assaulted his son in May 2011, and that this assault made Arthur Taken Alive an Habitual Domestic Abuser in violation of federal law.

Arthur Taken Alive, age 44, was indicted by a federal grand jury on August 22, 2011, for Assault Resulting in Serious Bodily Injury and Domestic Assault by an Habitual Offender. He appeared before United States Magistrate Judge William D. Gerdes on September 29, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years in custody, a $250,000 fine, or both. Restitution may also be ordered. The charges are merely accusations, and Taken Alive is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Bureau of Indian Affairs, Standing Rock Agency. Assistant United States Attorney Mikal Hanson is prosecuting the case. Taken Alive was temporarily remanded to the custody of the United States Marshal pending his December 6, 2011, federal jury trial.
