United States Attorney Brendan V. Johnson announced that a Cherry Creek man has been indicted by a federal grand jury for Assault with a Dangerous Weapon, Assault Resulting in Serious Bodily Injury, and Aiding and Abetting.
Lawrence Tyler Mexican, age 20, and a co-defendant, Jody “Jeremy” Dupris, age 31, were indicted by a federal grand jury on November 8, 2011. Mexican appeared before United States Magistrate Judge Mark A. Moreno on November 18, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years in custody, a $250,000 fine, or both. The charges relate to an allegation that the defendant assaulted a Cherry Creek man in August 2010. The charges are merely accusations, and Mexican is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant United States Attorney Mikal Hanson is prosecuting the case. Mexican was remanded to the custody of the United States Marshal. A trial date has not yet been set.
