Rosebud Man Pleads Guilty to Sexual Abuse of a Minor

United States Attorney Brendan V. Johnson announced that Wilson Provencial, age 23, of Rosebud appeared before United States District Judge Roberto A. Lange on November 22, 2011, and pled guilty to Sexual Abuse of a Minor. The maximum penalty upon conviction is 15 years' imprisonment, a $250,000 fine, or both.

The charge stems from an incident that took place on May 10, 2011, when Provencial gave the victim a ride from St. Francis to Rosebud. During the drive, Provencial parked his car and engaged in sexual contact with the victim. Provencial was aware that the victim was under the age of 16 at the time and that he was too old to have sex with her.

The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers.

A presentence investigation was ordered, and a sentencing date was set for February 13, 2012. The defendant was remanded to the custody of the United States Marshal pending sentencing.
