United States Attorney Brendan V. Johnson announced that Juan Colombe, age 19, of Mission, South Dakota, appeared before United States District Judge Roberto A. Lange on December 12, 2011, and pled guilty to Assault Resulting in Serious Bodily Injury. The maximum penalty upon conviction is 10 years' imprisonment, a $250,000 fine, or both.
The charge stems from an incident that took place on the 29th of June, 2011, when Colombe entered a residence and struck the victim with an ax handle. The victim fell to the floor and was hit several more times on the head and on his hands as the victim attempted to protect his head with his hands. The victim received 27 stitches to close wounds on his left hand and staples and stitches to close two lacerations on his head.
The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers.
A presentence investigation was ordered, and a sentencing date was set for March 5, 2012. The defendant was remanded to the custody of the United States Marshal pending sentencing.
