United States Attorney Brendan V. Johnson announced that an Eagle Butte, South Dakota, man has been indicted by a federal grand jury for Retaliating Against a Witness.
Allan Kermit Chasing Hawk, age 47, was indicted by a federal grand jury on December 14, 2011. He appeared before United States Magistrate Judge Mark A. Moreno on December 22, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 20 years’ custody, a $250,000 fine, or both.
The charge is merely an accusation, and Chasing Hawk is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Division.
The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers. Chasing Hawk was remanded to the custody of the United States Marshal.
