Pierre Man Pleads to Using Fraudulent Document

United States Attorney Brendan V. Johnson announced that Jose Carlos Martinez, age 34, of Pierre, appeared before US District Judge Jeffrey L. Viken on May 17, 2011, and pled guilty to a charge of Use of Fraudulent Identification Document. The maximum penalty upon conviction is five years of imprisonment and/or a $250,000 fine.

In April 2011, Martinez used a Lawful Permanent Resident Card bearing a number he knew was issued to another person. The investigation was conducted by ICE. The case is being prosecuted by Assistant US Attorney Sarah B. Collins.

A presentence investigation was ordered, and a sentencing date was set for June 20, 2011. The defendant was remanded to the custody of the US Marshal pending sentencing.
