United States Attorney Brendan V. Johnson announced that Sharon McMillan, age 41, of Long Valley, South Dakota, appeared before United States District Judge Jeffrey L. Viken on May 26, 2011, and pled guilty to a superseding information that charged her with Second Degree Murder. The maximum penalty upon conviction is up to life in prison, a $250,000 fine, or both; up to five years of supervised release; and a $100 special assessment to the Victim Assistance Fund. Restitution may also be ordered.
The charge relates to McMillan killing a man by hitting him in the head with a baseball bat on May 1, 2010, near Long Valley, South Dakota. The investigation was conducted by the Bureau of Indian Affairs, the Oglala Sioux Tribe Department of Public Safety, and the Federal Bureau of Investigation. The case is being prosecuted by Assistant United States Attorney Tim Maher.
A presentence investigation was ordered, and a sentencing date was set for August 22, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
