Denver Man Indicted for Illegally Living in United States

United States Attorney Brendan V. Johnson announced that a Denver man has been indicted by a federal grand jury for illegally living in the United States after having previously been deported.

Daniel Hermitano Diaz, a/k/a Guillermo Espinoza, age 47, after being arrested by the Rapid City Police Department for disorderly conduct, was indicted by a federal grand jury on June 7, 2011, for Illegal Reentry After Deportation. He appeared before US Magistrate Judge Veronica L. Duffy on June 9, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is two years of imprisonment and/or a $250,000 fine. The charge is merely an accusation, and Diaz is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Rapid City Police Department and the Bureau of Immigration and Customs Enforcement. Assistant US Attorney Robert A. Mandel is prosecuting the case. Diaz was remanded to the custody of the US Marshal. A trial date has not yet been set.
