US Attorney Brendan V. Johnson announced that a Minneapolis, Minnesota, man has been indicted by a federal grand jury for Failure to Pay Legal Child Support.
Michael A. Smith, age 36, was indicted by a federal grand jury on January 4, 2011, for failing to pay over $14,000 in past due child support. He appeared before US Magistrate Judge John E. Simko on January 24, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is two years’ imprisonment, a $250,000.00 fine, one year supervised release, one additional year upon revocation, a $100.00 assessment fee to the Victims’ Assistance Fund, and child support restitution amount owing at the time of sentencing. The charge is merely an accusation and Smith is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Department of Health and Human Services, Office of Inspector General. Assistant US Attorney Thomas J. Wright is prosecuting the case. Smith was released on bond pending trial. A trial date has been set for March 29, 2011.
