Colorado Man Sentenced for Failure to Pay Legal Child Support

US Attorney Brendan V. Johnson announced that a Denver, Colorado, man charged with Failure to Pay Legal Child Support was sentenced on March 28, 2011, by US District Judge Charles B. Kornmann. Donald A. Martinez, age 51, was sentenced to five years of probation, a $100 special assessment to the Victim Assistance Fund, and child support restitution in the amount of $16,022.75.

Martinez was indicted for failing to pay over $13,000 in past due child support by a federal grand jury on April 7, 2009. According to information from the Office of Child Support Enforcement, at the time of indictment Martinez had not made a child support payment since June 2006, and the total arrearage amount was $13,502.75. He pled guilty the charge on December 13, 2010.

This case was investigated the Department of Health and Human Services, Office of Inspector General. Assistant US Attorney Thomas J. Wright prosecuted the case.
