United States Attorney Brendan V. Johnson announced that a Mission man and woman charged with Possession of Marijuana by a federal grand jury were sentenced on January 17, 2012, by United States District Judge Roberto A. Lange. Brittany Shaw, age 32, was sentenced to 6 months of probation. Matthew Scott, age 22, was sentenced to 1 year of probation and a $500 fine. Each was ordered to pay a $25 special assessment to the Victim Assistance Fund.
The convictions arose from a September 22, 2010, tribal search warrant executed at the residence where Shaw and Scott lived. The seized items included individual bags of marijuana (8.72 ounces), a plastic baggy that contained marijuana (.49 ounces), a sweater that held a baggy of marijuana (.47 ounces), and various drug paraphernalia. Law enforcement also seized $356 from the residence that Shaw and Scott had obtained, directly or indirectly, by selling marijuana, or that was intended to be used to commit and facilitate the possession of marijuana. The $356 will be forfeited as part of their pleas of guilty.
This case was investigated by Rosebud Sioux Tribe Law Enforcement Services and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant United States Attorney Jay Miller prosecuted the case.
