United States Attorney Brendan V. Johnson announced that Paul Allen Joseph, age 60, of Wood, South Dakota, appeared before United States District Judge Roberto A. Lange on January 31, 2012. Joseph pled guilty to Felon in Possession of a Firearm. The maximum penalty upon conviction is 10 years' imprisonment, a $250,000 fine, or both.
In September 1991, Joseph was convicted of a felony in the District of South Dakota. On or about the 11th day of June, 2011, Joseph was arrested for driving under the influence. At the time of the arrest, Joseph was in knowing possession of a Ruger Model C9, 9mm Hi-Point pistol.
The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers.
A presentence investigation was ordered, and a sentencing date was set for April 23, 2012. The defendant was released on bond pending sentencing.
