U.S. Attorney Brendan V. Johnson announced that a Lower Brule man charged with Assault With a Dangerous Weapon was sentenced on February 13, 2012, by U.S. District Judge Roberto A. Lange. John R. Estes, II, age 35, was sentenced to 6 months in custody; 6 months of home confinement, 2 years of supervised release, and $100 assessment.
Estes was indicted by a federal grand jury in June 2011. In November 2011 he pled guilty to one count of the indictment charging him with Assault With a Dangerous Weapon.
The conviction stems from an incident in April of 2011 when the defendant and the victim had an argument. During the argument, the defendant displayed a black handgun, pointed the gun at the victim, threatened her with the handgun, and threatened to kill her.
This case was investigated by the Federal Bureau of Investigation. Assistant U.S. Attorney Meghan N. Dilges prosecuted the case.
Estes was allowed to self report to the custody of the U.S. Marshal on February 22, 2012, by 3:00 p.m.
