United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man charged with Sexual Abuse of a Minor was sentenced on February 13, 2012, by United States District Judge Roberto A. Lange. Wilson Provencial, age 24, was sentenced to 5 months in custody, 5 months of home confinement, 5 years of supervised release, and a $100 special assessment to the Victim Assistance Fund.
Provencial was indicted by a federal grand jury on June 22, 2011, and pled guilty to the charge on November 22, 2011.
The conviction stems from an incident that took place on May 10, 2011, when Provencial gave the 16-year-old victim a ride from St. Francis to Rosebud. During the drive and while in the vicinity of a gas station, Provencial parked his car and engaged in sexual contact with the minor. Provencial was aware that the victim was under the age of 16 at the time.
The investigation was conducted by Rosebud Sioux Tribe Law Enforcement Services. The case was prosecuted by Assistant United States Attorney Marie H. Ruettgers.
Provencial was remanded to the custody of the United States Marshal.
