United States Attorney Brendan V. Johnson announced that a Mission, South Dakota, man charged with Third Degree Burglary and Aiding and Abetting was sentenced on February 15, 2012, by United States District Judge Roberto A. Lange. Anthony Wayne Kitteaux, age 19, was sentenced to 10 months in custody, 3 years of supervised release, $2,684.74 in restitution, and a $100 special assessment to the Victim Assistance Fund.
Kitteaux was indicted by a federal grand jury on August 22, 2011, and pled guilty to the charge on October 20, 2011.
On May 30, 2011, Kitteaux broke into the Subway restaurant in Mission. Kitteaux broke into the store by breaking and climbing through a drive-up window. Kitteaux and his co-defendant were involved in taking drinks, food, chips, and U.S. currency or coins from the Subway restaurant.
This case was investigated by Rosebud Sioux Tribe Law Enforcement Services. Assistant United States Attorney Tim Maher prosecuted the case.
Kitteaux was immediately turned over to the custody of the United States Marshal.
