United States Attorney Brendan V. Johnson announced that a Rapid City man charged with Possession with Intent to Distribute Marijuana and Aiding and Abetting was sentenced on March 5, 2012, by United States District Judge Roberto A. Lange. Raymond Flute, age 27, was sentenced to 3 years of probation, a $1,000 fine, and a $100 special assessment to the Victim Assistance Fund.
Flute was indicted on September 13, 2011, for Possession with Intent to Distribute a Controlled Substance and Aiding and Abetting. He pled guilty to the indictment on December 13, 2011. The conviction arose from a traffic stop for speeding on April 23, 2010. Raymond Flute, driver of the vehicle, and Jane Big Eagle, registered owner of the vehicle and a passenger in it, were arrested. An inventory search revealed a Crown Royal bag filled with 44 individually wrapped baggies of marijuana in the locked glove compartment.
This case was investigated by the Bureau of Indian Affairs, Lower Brule Agency, and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant United States Attorney Jay Miller prosecuted the case.
