McLaughlin Man Indicted for Assault with a Dangerous Weapon

United States Attorney Brendan V. Johnson announced that a McLaughlin man has been indicted by a federal grand jury for Assault with a Dangerous Weapon.

Kevin Fischer, age 43, was indicted by a federal grand jury on March 14, 2012. He appeared before United States Magistrate Judge William D. Gerdes on March 22, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years in custody, a $250,000 fine, or both.

The charge relates to an allegation that the defendant assaulted a woman and her son in March 2012. The charge is merely an accusation, and Fischer is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Bureau of Indian Affairs, Standing Rock Agency. Assistant United States Attorney Mikal Hanson is prosecuting the case. Fischer was released on bond pending trial. A trial date has not yet been set.
