United States Attorney Brendan V. Johnson announced that a Winner man charged with Conspiracy to Distribute and Possess with Intent to Distribute a Controlled Substance, Marijuana, by a federal grand jury was sentenced on April 11, 2012, by United States District Judge Roberto A. Lange. Timothy Flammond, age 29, was sentenced to 12 months and 1 day of custody, 4 years of supervised release, and a $100 special assessment to the Victim Assistance Fund.
The conviction arose from a June 2011traffic stop conducted by Rosebud Tribal Police on a vehicle driven by Timothy Flammond. When a narcotics detection police dog alerted on the vehicle, a search was conducted and marijuana and drug paraphernalia were found. Further investigation revealed that Timothy Flammond and others were involved in a marijuana distribution conspiracy that had begun in January 2011. The drug quantity attributed to Flammond, based on his role in the conspiracy, was at least 1 kilogram, but less than 2.5 kilograms, of marijuana.
Flammond has a prior felony conviction for a drug offense. On May 31, 2001, he was convicted for the offense of Illegal Possession/Use of a Controlled Substance in the District Court of Davis County, State of Utah.
This case was investigated by Rosebud Sioux Tribe Law Enforcement Services, the Mellette County Sheriff’s Office, and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant United States Attorney Jay Miller prosecuted the case.
