United States Attorney Brendan V. Johnson announced that a Wakpala man, charged with Sexual Abuse, was sentenced on April 16, 2012, by United States District Judge Charles B. Kornmann. Justin Birdhorse, age 34, was sentenced to 276 months in custody, 5 years of supervised release, and a $100 special assessment to the Victim Assistance Fund.
Birdhorse was indicted for Sexual Abuse and Aggravated Sexual Assault by Force by a federal grand jury on August 22, 2011. He pled guilty to Sexual Abuse on January 10, 2012.
The conviction arose from an August 12, 2011, incident at Wakpala when Justin Birdhorse assaulted the victim in her home. This case was investigated by the Federal Bureau of Investigation and the Bureau of Indian Affairs, Standing Rock Agency. Assistant United States Attorney Mikal Hanson prosecuted the case.
Birdhorse was immediately turned over to the custody of the United States Marshal to begin serving his sentence.
