United States Attorney Brendan V. Johnson announced that a Mission woman has been indicted by a federal grand jury for three counts of Assaulting, Resisting and Impeding a Federal Officer.
Marjorie Lunderman, age 26, was indicted by a federal grand jury on April 10, 2012. She appeared before United States Magistrate Judge Mark A. Moreno on April 19, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 20 years in custody, a $250,000 fine, or both.
The charges relate to an allegation that the defendant assaulted two federal officers, employed at the Rosebud Sioux Tribe Police Department, in May 2011. The charges are merely accusations, and Lunderman is presumed innocent until and unless proven guilty.
The investigation is being conducted by Rosebud Sioux Tribe Law Enforcement Services and the Northern Plains Safe Trails Drug Enforcement Task Force. Assistant United States Attorney Jay Miller is prosecuting the case. Lunderman was remanded to the custody of the United States Marshal. A trial date has not yet been set.
