United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man has been indicted by a federal grand jury for Felon in Possession of a Firearm, Drug User in Possession of a Firearm, Domestic Violence Offender in Possession of a Firearm, Possession of Unregistered Firearm, and Possession of Firearm Unidentified by Serial Number.
Zane M. Swimmer, age 53, was indicted by a federal grand jury on April 10, 2012. He appeared before United States Magistrate Judge
Mark A. Moreno on April 12, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years’ custody, a $250,000 fine, or both; 3 years of supervised release; and a $100 special assessment on each count. Restitution may also be ordered.
The charges are merely accusations, and Swimmer is presumed innocent until and unless proven guilty.
The investigation is being conducted by Rosebud Sioux Tribe Law Enforcement Services and the Bureau of Alcohol, Tobacco, Firearms, and Explosives. The case is being prosecuted by Assistant United States Attorney Tim Maher. Swimmer was remanded to the custody of the United States Marshal.
