Eagle Butte Man Pleads Guilty to Assault

U.S. Attorney Brendan V. Johnson announced that Ervin D. Addison, age 30, of Eagle Butte, appeared before U.S. District Judge Roberto A. Lange on April 30, 2012, and pled guilty to Count I of an Indictment that charged him with Assault with a Dangerous Weapon. The maximum penalty upon conviction is 10 years' imprisonment, a $250,000 fine or both.

The conviction stems from an incident on July 23, 2011, when Cheyenne River Tribal Police responded to a reported stabbing. The tribal police met with Addison’s parents who reported that Addison had stabbed the victim after he had been picked up at a friend's house. After stabbing the victim, Addison immediately turned around and stabbed himself several times in the stomach.

Medical records of the victim show a 2 cm laceration above the sternum. The victim was transferred to Rapid City Regional Hospital for further evaluation which revealed that the cut extended more than 2 cm into deeper tissue. The victim was also 14 weeks pregnant at the time of the incident.

The investigation was conducted by Cheyenne River Sioux Tribe Law Enforcement Services. The case is being prosecuted by First Assistant U.S. Attorney Randolph J. Seiler.

A presentence investigation was ordered, and a sentencing date was set for July 16, 2012. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
