United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man has been indicted by a federal grand jury for Assault with a Dangerous Weapon, Assault Resulting in Serious Bodily Injury, and Discharging, Brandishing, Carrying or Possessing a Firearm During and in Relation to a Crime of Violence.
Barry Allman, age 21, was indicted by a federal grand jury on May 8, 2012. He appeared before United States Magistrate Judge Mark A. Moreno on May 14, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is up to life in prison, a $250,000 fine, or both.
The charges are merely accusations, and Allman is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation, Bureau of Alcohol, Tobacco, Firearms, and Explosives, and Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers. Allman was remanded to the custody of the United States Marshal.
