Rosebud and St. Francis Men Arraigned on Charges of Third Degree Burglary and Larceny

United States Attorney Brendan V. Johnson announced that a Rosebud man and a St. Francis man have been indicted by a federal grand jury for Third Degree Burglary, Larceny, and Aiding and Abetting.

Steven Whiting, age 18, and Paul Guerrero, age 22, were indicted by a federal grand jury on May 8, 2012. They appeared before United States Magistrate Judge Mark A. Moreno on May 22, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years’ custody, a $250,000 fine, or both; 3 years of supervised release; and a $100 special assessment. Restitution may also be ordered.

The charges are merely accusations, and Whiting and Guerrero are presumed innocent until and unless proven guilty.

The investigation is being conducted by Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Marie H. Ruettgers. Whiting and Guerrero were released to third party custodians pending trial.
